Joshlin Smiths Mother, Kelly Convicted Of Her Kidnapping

Kelly Smith and her co-accused have been convicted of kidnapping and trafficking her daughter, Joshlin Smith.

The Western Cape High Court has found that the state proved beyond reasonable doubt that Smith, her boyfriend, Jacquen Appollis and their friend Steveno van Rhyn sold the six-year-old girl for the purposes of exploitation.

A timeline in the evidence presented by the state against the accused, including that of the state witnesses, has been detailed in court.

The court has heard that the majority of the evidence stands undisputed.

Presiding Judge Nathan Erasmus said: I was told that what they admitted to in those statements came from the police and the police told them what to say. I have no hesitation in finding that the evidence for the defence in that score was so bad that nobody can believe it, that nobody can come and testify again because the prosecutors wiped the floor clean with their evidence to use the colloquial term.
