The High Court in Gqeberha will on Monday hear the first part of the appeals process by the state regarding the acquittal of televangelist pastor Timothy Omotoso and his two co-accused on human trafficking and rape charges.

The prosecution and defence will argue in court regarding the states request for clarification of factual findings from the judge.

Judge Irma Schoeman found in April that the state did not prove beyond reasonable doubt that Omotoso and his co-accused committed the crimes.

National Prosecuting Authority NPA spokesperson Mthunzi Mhaga says the State sent a request for clarification of the factual findings.

This is the only limited mechanism in which the state can appeal an acquittal judgment in South African law. We take the view that it will be appropriate and in order for the Honourable Judge to provide such clarification before the State can identify and request her to reserve those questions of law.
