A Federal High Court sitting in Kano and presided over by Justice A.M Liman has restrained acclaimed executive members of All Progressive Congress, APC, Ganduje Ward from suspending the National Chairman of the party and former Governor of Kano State, Dr. Abdullahi Umar Ganduje, pending the hearing and determination of the substantive application for the enforcement of fundamental rights of the applicant.

The applicant, Ganduje had approached the Court, through his counsel, Bar. Hadiza Nasir Ahmed, seeking the enforcement of his fundamental rights to fair hearing and freedom of association, pursuant to the Enforcement and Procedure Rules, 2009 as subsumed under Section 46 of the Constitution of Federal Republic of Nigeria, 1999 as amended.

Justice Liman gave the order after the hearing of an application exparte moved by his legal representative, Bar. Hadiza Nasir Ahmed.

The presiding judge directed all the parties in the suit to maintain status quo before the purported emergency meeting of the alleged Executive Members of APC Ganduje Ward, held at unknown location and to stay all action in respect of this matter, pending the hearing and determination of motion on notice.

That all the Respondents, their servants, agents or privies are hereby restrained from implementing and or given effect to the purported decision reached during the purported Emergency Meeting of the alleged Executive Members of APC Ganduje Ward, on the 20 April, 2024 pending the hearing and determination of the substantive application for the enforcement of fundamental rights of the Applicant.

That all the parties are hereby mandated to maintain status quo before the purported Emergency Meeting of the alleged Executive Members of APC Ganduje Ward, held at unknown location and to stay all actions in respect of this matter, pending the hearing and determination of the substantive application, the court order reads.

The respondents in the suit include; Basiru Nuhu Isah and 25 Others.

Other parties joined as respondents are; Nigeria Police Force, Commissioner of Police, Kano Command, Inspector General of Police and Department of State Security Service.
