Du Toit was charged with crimen injuria and malicious damage to property when the three-year-long case began in 2022.

He was expelled from the university after video footage of an intoxicated Du Toit urinating on the belongings of Babalo Ndwanya, a fellow student at the time, inside a room of the universitys Huis Marais residence went viral on social media , and he was found guilty of contravening the university's disciplinary code for students in a disciplinary hearing.

It was alleged by Ndwanyana in his second affidavit that Du Toit uttered Its a white boy thing after the video stopped being recorded.

According to Du Toits attorney, Dirk van Niekerk, the state was unable to prove that the former student had acted with criminal intent, leading to the full acquittal, nor could the state prove that there had been any damage to his property.
